SAM Magazine--Boise, Idaho, November 9, 2009--A group of homeowners at Tamarack Resort that have been trying to keep the resort from permanently closing down, will have their day in court. According to published reports, a judge will let the homeowners intervene in a foreclosure lawsuit, which includes the Credit Suisse Group, as several companies try and recoup the more that $300 million owed by Tamarack for construction.

The homeowners have proposed getting a $7.9 million loan from a Mexican group in order to keep the area open this season. However, as part of the loan agreement, the Mexican group would go to the head of the line for repayment, which has angered the group filing the foreclosure suit.

The judge did not favor the plan for the loan, but did say he would allow nine homeowners to make their cases in court. No date has been set, but time is quickly running out as the winter season approaches.
