SAM Magazine--October 20, 2010--A jury returned a unanimous defense verdict yesterday in the case of James Malaguit v. Ski Sundown, Inc., in the Connecticut Superior Court, Litchfield, Conn. James Malaguit was 15 years old on February 17, 2006, when he went off a terrain feature in Ski Sundown's terrain park. He reverse rotated and landed on the back of his head and neck, rendering him a quadriplegic. Malaguit sued Ski Sundown, alleging that his injuries were the result of Ski Sundown's negligence. Dr. Jasper Shealy, Mark Petrozzi, VP of risk management for Booth Creek Ski Holdings, Inc., and John Fry, the former editor-in-chief of "Ski Magazine," testified on behalf of Ski Sundown. Ski Sundown was represented by Mark B. Seiger and Charles F. Gfeller, of Seiger Gfeller Laurie LLP. The jury deliberated for less than an hour and a half before reaching its verdict in favor of Ski Sundown.
