SAM Magazine--May 14, 2013--According to the Times-Tribune, a judge ruled that a mountainside community can restrict water access to Elk Mountain, Pa. At issue is a 10-acre lake that is connected to the resort's 4-acre snowmaking pond. In 2011, the Village of Four Seasons revoked Elk's right to draw water from the lake and filed suit later that year after the ski area continued to draw water from the lake. The Village also requested in the suit that a gate be reopened allowing the community access to the mountain. At issue is a 10-acre lake that is connected to the resort's 4-acre snowmaking pond. In 2011, the Village of Four Seasons revoked Elk's right to draw water from the lake and filed suit later that year after the ski area continued to draw water from the lake. The Village also requested in the suit that a gate be reopened allowing the community access to the mountain. The judge ruled that Elk had the right to close the access point in early February. In his opinion on the water rights, the Susquehanna County Court judge ruled that the Village owns the lake and "has the right to regulate it as it pleases."
